General terms and conditions of business

Please note that for reasons of easier readability, gender-specific differentiation is omitted. In the spirit of equal treatment, corresponding terms apply to all genders.

1. Contracting party

Your purchase contract is concluded with BOOM my Brand LTD (hereinafter "Wohnwelt", "we", "us"), 7 Bell Yard, London, WC2A 2JR, United Kingdom.

2. Scope

For all mutual claims arising from and in connection with the conclusion of a contract for the delivery of goods between the customer (hereinafter also referred to as "you") and BOOM my Brand LTD, these General Terms and Conditions in the version valid at the time of the respective conclusion of the contract always apply. Orders on "Wohnwelt" are possible for all persons from the European Economic Area, regardless of their place of residence, origin or nationality.

3. Conclusion of contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the order button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after we receive it. Confirmation of receipt does not constitute acceptance of the contract.

3.2 We can accept your order by sending a declaration of acceptance in a separate email or by delivering the goods within 2 working days, whereby receipt by the customer is decisive. If working days are specified as deadlines, this means all weekdays with the exception of Saturdays, Sundays and public holidays.

3.3 BOOM my Brand LTD will use your personal data and information that you provide to us to process orders, deliver goods and process payments. The item you have ordered will be delivered by a transport company commissioned by us. For this purpose, we will send your email address to this transport company so that the transport company can send you information about the status of your shipments and a specific delivery date by email.

3.4 Registered customers can order qualified shopping baskets and products via quick order without going through the checkout process. By clicking on "Order now for a fee", the order is placed under the conditions specified in the quick order. By placing the quick order, the general terms and conditions are accepted.

4. Contract text storage and contract language

4.1 We save the contract text and send you the order data by email. You can also view the terms and conditions at any time at www.sparwelt-wohnen.shop . You can view your previous orders in the "My Orders" area if you have registered as a customer and logged in to the website with your access data.

4.2 The contract language is German.

5. Cancellation policy

Consumers have the following right of withdrawal:

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The cancellation period shall be 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the last good.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail).

If you make use of this option, we will immediately send you (e.g. by email) a confirmation of receipt of such a revocation.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We will bear the cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling by you which is not necessary to check their quality, properties and functioning.

For goods that cannot be returned by post due to their nature and that are marked as “bulky goods” on the invoice, the following applies: We will collect the goods.

The following applies to all other goods: We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the 14-day period.

6. Obligation to delete data

6.1 When returning devices with storage media (e.g. hard drives, USB sticks, etc.), for whatever reason (warranty, repair, reversal of the purchase, etc.), the customer is obliged to back up data, in particular personal and confidential data, from the devices before returning them and then delete them permanently and securely.

7. Reservation of self-supply

If BOOM my Brand LTD is not supplied through no fault of its own, despite having placed identical orders with reliable suppliers, BOOM my Brand LTD will be released from its obligation to perform and may withdraw from the contract. We will inform the customer immediately of the unavailability and, in the event of withdrawal, will immediately refund any payments already made to the customer.

8. Delivery/Shipping costs

8.1 In addition to the stated product prices, any shipping costs and a surcharge for small quantities must be paid by the customer. Our current prices and the associated shipping conditions for the desired delivery and shipping methods can be viewed at www.sparwelt-wohnen.shop . These are subject to change. Please therefore note possible updates. For bulky items, which are individually indicated accordingly, we also charge a bulky goods surcharge indicated on the product.

8.2 Subject to self-supply, "Wohnwelt" will ensure prompt delivery. If part of the order cannot be delivered immediately because "Wohnwelt" itself was not supplied on time through no fault of its own, despite having placed identical orders with reliable suppliers, the remaining goods will be delivered without recalculating the flat rate shipping fee, provided this is reasonable for the customer.

9. Price, payment terms

9.1 The prices stated in the online shop for consumers are total prices and include statutory sales tax or, in the case of insurance benefits, statutory insurance tax. Any additional shipping costs are stated separately for the respective products. You can find the respective total price and the specific composition of the price components in the order overview (Check Order Page) before completing the purchase. You can view your invoices in the "My Account" area if you have registered as a customer and logged in to the website with your access data. The invoices are made available to you electronically in PDF format for download.

9.2 If you choose to pay in advance, we will send you our bank details by email, fax or post. The purchase price must be credited to our account within 7 days of receiving this information. We will then send you the ordered goods.

9.3 If you choose PayPal as your payment method, you will automatically be redirected to PayPal's secure payment form after submitting your order. If you already have a PayPal account, simply log in. Otherwise, click on Set up account and follow the instructions. We will receive your payment within seconds and your goods can be dispatched immediately if they are available.

9.4 We also offer the Sofort payment method. All you need is your account number, bank code, PIN and TAN. After submitting your order, you will automatically be redirected to the secure payment form of Sofort GmbH - A Klarna Group Company. You will receive confirmation of the transaction immediately afterwards. We will then receive the transfer credit immediately. In principle, any Internet user can use Sofort as a payment method if they have an activated online banking account with a PIN/TAN procedure. Please note that Sofort is not yet available at a few banks. You can find more information about whether your bank supports this service here: https://www.sofort.com/ger-DE/general/fuer-kaeufer/fragen-und-antworten/

9.5 If you agree to pay by direct debit, you give us a direct debit authorization (= SEPA direct debit mandate). The invoice amount will not be debited from us until 16 days after the invoice is issued. The invoice will be issued upon acceptance of the order.

9.6 If you have chosen to pay by credit card, the required details must be provided to us when placing your order. Your credit card will be charged at the time we accept your order.

9.7 If you choose to pay by invoice, the purchase price is due after the goods have been delivered and invoiced. Please transfer the invoice amount without deduction within 16 days of the invoice being issued.

10. Retention of title

"Wohnwelt" reserves title to all goods delivered by it to a customer until full payment of the delivered goods.

11. Warranty

11.1 The statutory liability for defects applies to all goods. In the case of material defects, the quality agreement takes precedence over the objective requirements.

11.2 If delivered goods show obvious transport damage, the customer is asked to complain about such defects to "Wohnwelt" as soon as possible. Failure to complain has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the freight carrier or the transport insurance. If the customer acts as a merchant within the meaning of Section 1 of the German Commercial Code (HGB), the commercial obligation to inspect and complain pursuant to Section 377 of the German Commercial Code (HGB) applies to him.

11.3 The liability period for warranty claims for used goods marked in the respective offers as refurbished and/or demonstration goods is governed by law. The respective warranty period begins with the delivery of the goods to the customer. The above restrictions do not apply in the case of intentional or grossly negligent breaches of contract or fraudulent intent, in the event that culpable damage to life, health or body has occurred, within the scope of a quality and/or durability guarantee, insofar as we have given such a guarantee with regard to the goods delivered, or insofar as the scope of application of the Product Liability Act is open. In all other respects, the statutory provisions apply to the warranty, in particular the two-year limitation period from Section 438 Paragraph 1 No. 3 of the German Civil Code.

12. The Warranty

12.1 If manufacturers of the products you have selected offer a manufacturer's guarantee, this only binds the manufacturers and not "Wohnwelt", unless "Wohnwelt" has expressly given a guarantee to the customer. Detailed information on any additional manufacturer's guarantees that may apply and their exact conditions can be found on the product and on special information pages in the online shop.

12.2 If you make use of a warranty or wish to refer to such a warranty, you shall, without prejudice to your statutory rights, be entitled to the rights arising from the corresponding warranty, subject to the conditions set out in the warranty declaration, in each case against the relevant guarantor.

13. Liability

"Wohnwelt", its legal representatives and its vicarious agents are liable to the customer in cases of positive breach of contract, delay, impossibility, tort and for other legal reasons (except for contractual violations) as follows:

13.1 "Wohnwelt" is liable without limitation for any legal reason:
- in the case of intentional or grossly negligent breaches of contract and fraud,
- in the event that culpable damage to life, health or body has occurred,
- within the scope of a quality and/or durability guarantee, insofar as we have given such a guarantee with regard to the goods delivered,
- insofar as the scope of application of the Product Liability Act is open.

13.2 Only in the case of a negligent breach of essential contractual obligations (cardinal obligations) is the liability of "Wohnwelt" limited to the typical, foreseeable damage. Essential contractual obligations are obligations which the contract imposes on the seller according to its content in order to achieve the purpose of the contract, the fulfillment of which therefore makes the proper execution of the contract possible in the first place and on whose compliance the customer can regularly rely.

13.3 We would like to point out that data loss may occur during warranty work. Therefore, ensure that you back up your data regularly. We assume that you have backed up your data; if not, please inform us. Liability for data loss is limited to the cost of restoring the data if a backup copy exists, unless the data loss was caused intentionally or through gross negligence by "Wohnwelt". Otherwise, liability is excluded, with the exception of cases of intent or gross negligence.

13.4 The above provisions (Section 12 and Sections 13.1 – 13.3) reflect the full scope of liability of "Wohnwelt", its legal representatives and its vicarious agents.

14. Alternative dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr/ . We are not obliged and generally not willing to participate in a dispute resolution procedure before a consumer arbitration board.

15. Applicable law

15.1 All legal transactions and legal relationships between "Wohnwelt" and the customer are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, but with regard to consumers only to the extent that the consumer is not deprived of the protection granted to him by mandatory provisions of the state in which he has his habitual residence.
